Welcome to RadioStream! These Terms of Service ("Terms") govern your use of the various services provided by RadioStream and its subsidiaries, including DataCenter2 and SkillRadio. RadioStream offers web hosting, audio stream hosting and distribution, video hosting and distribution, software development, and Alexa Skills and Google Actions development and hosting (collectively referred to as the "Services"). We specialize in professional hosting, content distribution, and development solutions for online radio and television broadcasters.

By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you may not use our Services.

Privacy and Data Collection

RadioStream, DataCenter2, and SkillRadio do not request, collect, or store any personally identifiable information (PII) such as names, contact information, or payment details from end users of the content or streams hosted on our platforms. Our Services are designed to function without requiring the submission of personal data, respecting the privacy of our users. No personal data is stored beyond what is necessary for the technical operation and maintenance of the Services.

Use of Services

Our Services, including web hosting, audio/video stream hosting, and content distribution, are provided for lawful, non-commercial, or commercial use depending on your specific agreement with RadioStream or its subsidiaries. By using our Services, you agree to:

• Use the Services only for legitimate purposes and in accordance with all applicable laws and regulations.
• Refrain from attempting to hack, disrupt, or interfere with the proper functioning of our hosting platforms or any content distributed via our Services.
• Avoid using the Services in any unauthorized manner or for malicious purposes such as distributing malware, conducting denial of service (DoS) attacks, or any activity that could harm RadioStream, DataCenter2, SkillRadio, or our infrastructure and users.

Web, Audio, Video Hosting and Distribution

RadioStream, through its subsidiary DataCenter2, provides hosting and distribution solutions for web, audio, and video content. You are responsible for ensuring that all content you upload or distribute via our hosting platforms complies with relevant laws and does not violate any third-party intellectual property rights. RadioStream and DataCenter2 are not responsible for any user-generated content distributed through its platforms.

Any unauthorized or inappropriate use of our hosting services may result in the suspension or termination of your access to the Services.

Alexa Skills and Google Actions Development and Hosting

In addition to our core hosting services, RadioStream offers Alexa Skills and Google Actions development and hosting through its subsidiary SkillRadio. These Services are designed to complement our primary hosting platforms and are subject to the same rules governing web, audio, and video hosting as outlined above.

Limitation of Liability

RadioStream, DataCenter2, and SkillRadio provide these Services "as-is" without warranties of any kind, either express or implied. We make no guarantees regarding the availability, performance, or reliability of the Services. You understand and agree that RadioStream, DataCenter2, SkillRadio, their affiliates, and partners will not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, the Services.

By using our Services, you agree to indemnify and hold RadioStream, DataCenter2, and SkillRadio harmless from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content hosted on our platforms, or your violation of these Terms.

Intellectual Property

You retain ownership of any content you upload or distribute through our Services. However, by using our Services, you grant RadioStream, DataCenter2, and SkillRadio a non-exclusive, worldwide, royalty-free license to host, stream, distribute, and display your content solely for the purpose of providing the Services.

Modifications to Terms

RadioStream reserves the right to update or modify these Terms at any time. We will notify you of any significant changes by posting the updated Terms on our website or through the applicable platform. Continued use of the Services after any changes constitutes your acceptance of the modified Terms.

Termination

RadioStream, DataCenter2, or SkillRadio may suspend or terminate your access to the Services at any time, without notice, if we believe you have violated these Terms or any applicable law or regulation. Additionally, we reserve the right to terminate the Services for any other reason, including misuse, unauthorized access, or the distribution of harmful or illegal content.

Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Vancouver, British Columbia.
